(MKRI) — A total of 36 students from the Master’s Program at Bangka Institute of Law (STIH PERTIBA) of Pangkal Pinang visited the Constitutional Court (MK) on Tuesday, February 21, 2023. They were welcomed by expert assistant to constitutional justice Irfan Nur Rachman in the Court’s main hall.

In his presentation, Irfan said that the Constitutional Court is a constitutional justice institution, while the DPR (House of Representatives) and the President are the legislatures. The Court was a new institution founded after the constitutional amendment to direct laws.

Irfan said that judicial legal politics is legal policies that determine the direction of planning and development of the national legal system made by the judiciary through its decisions, in this case, the Constitutional Court. “Therefore, those who have a role in forming legal politics determine where the law is directed, and that is the Constitutional Court,” he explained.

He also stated that legal politics is simply understood as an official policy related to the law applied and to be applied at a certain time. Therefore, legal politics is the government’s and the House’s domain as the legislatures responsible for formulating the intended policy.

In addition, Irfan said achieving legal development will encourage the achievement of legal goals, which in turn will lead to the achievement of national goals. The goal of the law is to create justice, benefit, order, and legal certainty, which is not easily achieved if every law does not contain the goals of the state. The achievement of legal goals will lead to or move towards achieving national goals. As a means of achieving national goals, legal goals must be achieved first so that national goals will be realized well.

“The goals of the state as the direction of national development is in line with and closely related to the applicable and changing legal politics. The role of national legal politics is very important in achieving national goals,” he said.
