JAKARTA (MKRI) — The Constitutional Court sworn in Majelis Kehormatan Mahkamah Konstitusi (MKMK) or the Constitutional Court’s Ethics Council on Thursday, February 9, 2023 at its main hall. The swearing-in was led by Chief Justice Anwar Usman, with newly-inaugurated MKMK Secretariat comprising functional and structural officials and staff members in attendance. Constitutional Justice Enny Nurbaningsih, former constitutional justice of 2015–2020  I Dewa Gede Palguna, and Gadjah Mada University law lecturer Sudjito were sworn in as members of the MKMK.

The three council’s members stressed that they would follow Pancasila and the 1945 Constitution and comply with statutory legislation with integrity for dedication to nation and state.

“While doing or not doing anything for this responsibility, I will never receive directly or indirectly from anyone any promises or gifts in any form that are alleged to be directly or indirectly contrary to my duties. I will keep secret anything that according to its nature or by order I must keep secret. I will maintain integrity, be disciplined, dedicated, and professional and not abuse my authority and avoid disgraceful acts. I will work in an orderly, scrupulous, clean, and enthusiastic manner for the benefit of the nation and state,” the members swore.

Meanwhile, in his remarks, Chief Justice Anwar said the council’s swearing-in was an important response to the latest legal developments and its establishment an integral part of the endeavor to uphold the principles of constitutionality in a constitutional state. The council’s duty to protect the honor of constitutional justices is also an integral part as the justices hold judicial power and have the responsibility to uphold law and justice. Therefore, Chief Justice Anwar is obliged to support the implementation of the council’s duties, not only in terms of administrative matters but also substantive matters.

“As I emphasized yesterday when giving remarks at the swearing in of the secretariat team that will assist the Constitutional Court Ethics Council, as chief justice of the Constitutional Court, I have an interest in maintaining the council’s performance to work independently, impartially, and free from intervention from anyone, including myself as chief justice of the Constitutional Court, as well as from other constitutional justices. Currently, we give the council complete trust to work optimally to state the facts on the issue it is entrusted with,” he said.

The chief justice had urged the secretariat to work professionally and proportionally, and to have courage to say the truth. “Qullil haqqa walau kana murran. Say what is right even if it tastes bitter. May Allah SWT, the Almighty God, protect us all while doing this noble work of enforcing and guarding the Constitution in this beloved institution,” he stressed.

The Court formed the MKMK January 30 to investigate in Decision No. 103/PUU-XX/2022 on the material judicial review of Law No. 7 of 2020 on the Constitutional Court. Following Article 27A of Law No. 7 of 2020, the council comprises one sitting constitutional justice, one academic, and one public figure.
