ISTANBUL (MKRI) — The rapid exchange of information globally often influences practices from one country to another, including in the field of law. Islamic countries also then adopt constitutional review. The constitutional jurisdictions of Muslim countries have also been exchanging information and experience in constitutional review in recent years, for example through conferences. This time, the Constitutional Court of Turkey hosted one such event, where Constitutional Justice Wahiduddin Adams represented the Constitutional Court of the Republic of Indonesia (MKRI) to deliver a speech at an international conference on Friday, December 23, 2022 in Istanbul, Turkey.

In a session on constitutional review models in Muslim countries, he explained such practice in Indonesia. Indonesia, he asserted, is not an Islamic country, neither is it a secular one. It adopts a state ideology called Pancasila as its state ideology, whose precept of the belief in One Supreme God is imbued in the life of the nation.

Indonesia adopts a combination of the abstract review model, also known as the continental European model as it is adopted by many continental European countries, and the concrete review model, where its assessment of the legal standing tends to mimic that of the U.S.’ concrete review model.

He invited the attending constitutional jurisdictions to review past research on state administration by ulemas. He also promoted studies on classical literature with modern perspectives in order to answer questions on contemporary issues in society in relation to constitutionalism and Islam, especially in Muslim countries.

In the same panel, representatives from constitutional jurisdictions of Palestine, Iran, Somalia, Iraq, and Turkey also explained their country’s constitutional review model.
