ISTANBUL (MKRI) — The delegation of the Constitutional Court of the Republic of Indonesia (MKRI) led by Chief Justice Anwar Usman and Constitutional Justice Wahiduddin Adams visited the Consulate-General of the Republic of Indonesia in Istanbul, Turkey on Thursday, December 22, 2022. At the meeting, Consul-General Imam As’ari asked questions on the issuance of the newly-approved Criminal Code (KUHP) to the constitutional justices.
Constitutional justices are bound by code of ethics to hold back from expressing their views on cases that could potentially end up in the Constitutional Court. Therefore, the constitutional justices only relayed general information of the issue. Constitutional Justice Wahiduddin Adams revealed the decades-long development of the Criminal Code, which is a legacy of Dutch colonial era. He said Indonesia still had w lot of homework to replace colonial-era laws such as the Civil Code (KUHPer), which had undergone changes in the Netherlands.
He added that the Criminal Code, which had just been approved by the House of Representatives (DPR) in its plenary session, is not in effect immediately. It will be in effect in three years. In the meantime, the state can disseminate information on it to the public.
Invitation by Constitutional Court of Turkey
The MKRI’s visit to Turkey was a response to the invitation by the Constitutional Court of Turkey for the founding of a cooperation of constitutional jurisdictions among Muslim countries, which will be named “Conference of the Constitutional Jurisdictions of the Islamic World.”
Before the congress in which the institution will be established, the Constitutional Court of Turkey also organized a symposium, where Constitutional Justice Wahiduddin Adams will talk about the constitutional review model in Indonesia. The chief justices attending the congress will discuss the statute of the institution.
