(MKRI) — In order to safeguard the Constitution, the judicial review function cannot be avoided in the state administration because the 1945 Constitution emphasizes that Indonesia no longer adopts parliamentary supremacy, but the constitutional supremacy. In fact, this also happened in other countries that turned into a democracy, said Constitutional Justice Enny Nurbaningsih in a public lecture on “The Constitutional Court’s Role as the Guardian of the Constitution” on Saturday, December 17, 2022 in the seminar room of the Law Faculty of IBA University.

She said the Constitutional Court was formed to guarantee that there would be no more legal products that violate the Constitution, so the citizens’ constitutional rights are protected and the Constitution is guarded. “The Constitutional Court functions as the guardian of the Constitution, in that it keeps the norms of law from causing constitutional issues. [It] is a form of checks and balances,” she said.

She further explained that the Court as an interpreter of the Constitution implies that only interpretation by the Constitutional Court through its is legally binding. “The Constitutional Court being the final interpreter of Constitution means there is no other institution that has the authority to interpret the Constitution,” she added.

Justice Enny said that, apart from being the guardian and final interpreter of the Constitution, the Constitutional Court is also the guardian of democracy, the protector of the citizens’ constitutional rights, and the protector of human rights.
