THE HAGUE (MKRI) — The recharging program of 2022 on “The Digital Transformation of Constitutional Adjudication in the Covid-19 Era: Legal and Ethical Dimensions” organized by the Constitutional Court of the Republic of Indonesia (MKRI) in collaboration with The Hague University of Applied Sciences (THUAS) was officially concluded by Constitutional Justice Enny Nurbaningsih on Friday, December 9, 2022. Seven participants joined the program.
Febrizki Bagja Mukti from the Indonesian Embassy and, Program Director of International and European Law Clair Moore, senior lecturer in law Michail Vagias, and team leader of Business Development and Continuous Professional Development Joost de Langen were in attendance.
In her remarks, Justice Enny said that the COVID-19 pandemic had had a significant impact on the use of internet, which forced the law enforcement field to change from face-to-face activities to online ones and to implement strict health protocol in on-site activities.
She also said that despite crises such as a pandemic, the constitutional rights of citizens must remain protected. “In accordance with the Constitutional Court’s authorities, if any law infringes on the citizens’ constitutional rights, upon request by the petitioner, the Court may take a role in protecting, advancing, and rehabilitating the citizens’ constitutional rights despite a pandemic situation,” she said.
This is the Constitutional Court’s commitment to protect the people’s safety, following Cicero’s maxim salus populi suprema lex esto, which means “The health (welfare, good, salvation, felicity) of the people should be the supreme law.”
Pandemic and Constitutional Court’s Efforts
Justice Enny also talked about the Court’s efforts to adjust its work system to the pandemic. Since its foundation days, it has had electronic-based systems, which made it easier to adapt to using technology.
“As a modern and trusted judicial institution, the Constitutional Court implements the e-court system, which is technology-based judicial services aimed at improving public access to justice and the judiciary through tools such as the Electronic Petition Information System (Simpel) and the smart board mini courtrooms at universities throughout Indonesia,” she stressed.
She also said that all Constitutional Court activities are publicized on its website, which can be accessed freely by the public. Technology in the judiciary, she added, is an inevitability.
Indonesia-Netherlands Cooperation
Justice Enny hoped that the cooperation between the MKRI and THUAS would continue. The recharging program, she said, was part of the Court’s commitment to developing the capacity of its staff members and to improving their knowledge and insights following developments in the legal field.
“I hope investments on human resources will help the Constitutional Court of the Republic of Indonesia to be better in managing cases and making decisions. We always encourage the staff members to uphold academic values that can provide substantive support to the constitutional justices in managing cases,” she said.
Concluding her remarks, Justice Enny hoped that after coming back to Indonesia and the office, the participants of the program would implement the knowledge that they had learned, especially to support the constitutional justices and the Constitutional Court.
As part of its official visits to the Netherlands, the MKRI delegation also visited the Indonesian Embassy in the Hague. Indonesian ambassador to the Netherlands, Mayerfas, immigration attaché Ronald A. Abdullah, and counsellor Febrizki Bagja Mukti welcomed the delegation warmly and expressed their enthusiasm for the visit. Ambassador Mayerfas hoped the visit would strengthen relations between the two countries, and especially help the Constitutional Court in improving the quality and capacity of its staff.
