Court Discusses CCJ-OIC Statute

MALANG (MKRI)—Secretary-General M. Guntur Hamzah attended the Secretaries-General Meeting of the Working Committee of the Conference of Constitutional Jurisdiction of OIC Member States (CCJ-OIC) on Thursday, November 3, 2022 virtually from Batu, Malang, East Java. At the meeting, the delegation of the Constitutional Court of the Republic of Indonesia (MKRI) offered recommendations for the draft of the CCJ-OIC Statute. All of the working committee members—the MKRI, the Constitutional Court of the Republic of Türkiye, the Supreme Court of Pakistan, the Supreme Court of Gambia, and the Constitutional Council of Algeria—attended the meeting virtually.

Starting the discussion, Guntur expressed the MKRI’s opinion on the languages of the association proposed by Algeria—Arabic and French besides English. He proposed that Arabic and French be focused for speech, but for documents to remain to be in English. Other members agreed on this proposal until they reached a unanimous agreement.

Next, he proposed that mandatory membership financial contribution not be set in this initial statute. “Basically, I agree that we need to regulate the financial contribution and management of the CCJ-OIC, but let it be a homework to discuss at a later date,” he said.

Agreeing with the MKRI, Secretary-General of the Constitutional Court of the Republic of Türkiye Murat Sen also expressed his Court’s opinion that since the association was still new, it was not yet necessary to discuss permanent secretariat at that meeting.

In the opening session, Constitutional Justice Arief Hidayat had the honor to deliver a motivational speech, in which he said that the statute would be initial rules for the new organization. Therefore, it must not be too rigid or complicated, so as to attract more members to join. “For me, as long as the general values can be agreed on, we can revise the details at a later date,” he concluded.

This meeting served to prepare for the inauguration congress to be hold in the end of December 2022. CCJ-OIC was founded in Bandung, West Java, Indonesia on September 17, 2021 through the Bandung Declaration on Human Rights and Constitutionalism.
