JAKARTA (MKRI)—Chief Justice Anwar Usman opened the Constitutional Justices Work Meeting (raker) on “Drafting Constitutional Court Regulations and Preparation for Constitutional Cases in 2023-2024” in Malang, East Java on Thursday-Sunday, November 3-6, 2022. Constitutional justices as well as structural and functional officials in the Registrar’s Office and the Secretariat-General of the Constitutional Court attended the meeting.

He said that the business process in the judiciary cannot be separated from public trust in the judiciary, thus it must be maintained with integrity. “Therefore, integrity must be implemented and developed by all components of the Constitutional Court. Integrity is a deal-breaker,” he said.

The Court is committed to make great contributions to just election. In order to hand down just decisions, moral and intellectual integrity is required. Moral integrity demands the judiciary to use logic to become honest, clean, and independent. Meanwhile, intellectual integrity determines the quality of legal considerations in Court decisions.

Finalizing PMK

Chief Justice Anwar Usman further explained that the raker was a routine. “The substance is the responsibility of the constitutional justices with the support of the Court’s apparatuses,” he said.

“In order to prepare for the constitutional cases in 2023-2024, the work meeting also aims at building togetherness, kinship, and teamwork among the Constitutional Court’s extended family,” he stressed.

He also said that the raker was needed for discussion and evaluation ahead of the constitutional cases in 2023-2024 and for the drafting of constitutional court regulations (PMK). At the pre-raker meeting the month before, the Court decided that it would finalize 8 PMKs.

Ready for Election

Meanwhile, Secretary-General M. Guntur Hamzah said in his report that 177 participants joined the raker, whose main agenda was to discuss the Court’s preparations ahead of the 2024 simultaneous general and regional election and the finalization of PMKs on the Court’s Ethics Council, procedural laws, and the Court’s authority in judicial review of laws and regional election.

He said that Indonesia will hold simultaneous presidential and legislative election in February 14, 2024. Then, it will hold the regional head election in November 27, 2024 simultaneously nationally.

“[I] would like to report that the PMK No. 1 of 2022 on the Stages, Activities, and Schedule of the Settlement of Disputes over the Results of DPR, DPD, DPRD, and Presidential Elections, which was signed by the Chief Justice, to the BPK. The BPK appreciated it and said that the Court was ready,” he said.

Guntur also reported that a capacity building program would also be held alongside the work meeting. It aimed at improving cooperation and solidarity between the constitutional justices and all parts of the Constitutional Court.
