Justice Suhartoyo Urges Prospective Advocates to Master Procedural Laws

JAKARTA (MKRI)—In order to improve the capacity of prospective advocates, the Association of Indonesian Advocates (Peradi) collaborated with the central executive board (DPP) of the Indonesian Advocates Society (IKADIN) and the University of Pamulang (Unpam) to organize the special education for professional advocates (PKPA) Batch VII on Monday, October 31, 2022. Constitutional Justice Suhartoyo delivered a presentation to introduce the participants to the Constitutional Court’s procedural laws.

Delivering the presentation virtually, Constitutional Justice Suhartoyo introduced the participants to the legal basis to the establishment of the Constitutional Court (MK). Following Article 24 paragraph (2) of the 1945 Constitution, the Constitutional Court became one of the executors of the judicial power in Indonesia and was granted four authorities and one obligation: reviewing laws against the 1945 Constitution, settling authority disputes between state institutions, deciding the dissolution of political parties, settling disputes over general election results, as well as deciding the House’s opinion on an alleged violation of law committed by the president and/or vice president. Until today, the Court has not exercised this obligation.

The Constitutional Court’s authorities also expanded with the addition of reviewing government regulations in lieu of laws (perppu), which it believes can lead to new legal norms whose force equal that of laws.

For judicial review, which is the Court’s main authority, every citizen who has legal standing and whose constitutional rights are harmed by a legal norm can file a petition, Justice Suhartoyo explained. After explaining how the constitutional justices perform their legal duty, he also urged the prospective advocates to understand the nature of the Constitutional Court’s decisions.

“Prospective advocates need to understand this because you will help justice seekers resolve [their] legal issues and [fight for] their constitutional rights until they find justice,” he said.

After the presentation, Justice Suhartoyo opened a discussion with the prospective advocates about their questions on the Constitutional Court.
