Court Drafts Regulation Ahead of 2024 General and Regional Elections Disputes

JAKARTA (MKRI)—Ahead of the 2024 Simultaneous General and Regional Elections, the Registrar’s Office and the Secretariat-General of the Constitutional Court (MK) held a pre-work meeting for drafting the Constitutional Court regulation (PMK) and preparing for the 2024 simultaneous general election results dispute resolution (PHPU) and the regional election results dispute resolution (PHP Kada) on Thursday, October 13, 2022 in Cianjur, West Java.

At the official opening, Chief Justice Anwar Usman said that nine concepts of regulation would be discussed at the meeting, so hopefully the constitutional justices could offer their direction and views. The number of cases in the 2019 Simultaneous Election and the 2020 Simultaneous Regional Election (Pilkada), he added, could serve as material for consideration in preparing for the 2024 Simultaneous Elections.

In the 2019 Simultaneous Elections, the Court handled 261 cases—260 of legislative election disputes (DPR, DPD, and DPRD) and 1 presidential election dispute. All 20 political parties participating in the election filed petitions to the Court. In addition, 10 individual petitions for DPD was filed from 6 provinces.

“This data can be material for the Court to prepare because the KPU has released information that in the 2024 Simultaneous Elections, 24 political parties have complete documents, while 16 others are still undergoing verification. The determination of the number of political parties participating in the general election is scheduled for December 14. Compared to the 2019 Simultaneous Election, it is certain that the number will be higher,” the chief justice said.

He said that the increase would certainly have an impact on the Court’s preparations and implementation of the technical assistance programs, both for election participants and the Court apparatus. Potential increase of voters must also be anticipated.

“It must be noted that the need for justice in the community is always changing, thus the Court must be dynamic and follow existing developments. Realizing this, as judicial apparatus, we should be cautious and sensitive in seeing the changes and developments that occur in society,” he said. 

PMK Concepts

Secretary-General M. Guntur Hamzah said in his report that this pre-work meeting focused on providing directions from the constitutional justices by discussing, finalizing, and ratifying the PMK concepts, which include that on the Court’s Ethics Council; the election of the chief justice and deputy chief justice; procedure for the formal judicial review; procedure for the material judicial review; the stages, activities, and schedule for PHPU; the procedure for the PHPU of DPR and DPRD election; the procedure for the PHPU of DPD election; the procedure for the PHPU of presidential election; and procedure for PHP Kada.

“We hope that this meeting will provide inputs, outputs, and outcomes that are beneficial for stakeholders,” he said before Chief Registrar Muhidin, Echelon II/III/IV officials, substitute registrars, expert assistants to constitutional justices, and ASNs (state civil apparatus) in the Registrar’s Office and the Secretariat-General of the Constitutional Court,” he said.

The meeting was planned for four days, Thursday-Sunday, October 13-16, 2022 in order to prepare optimal support in judicial administration, general administration, and security. Judicial administrative support is carried out in accordance with procedural law and technical instructions for PHPU and PHP Kada, especially during petition reception, hearings, and post-rulings. It includes support in case registration administration, judicial administrative techniques, case file administration, court management, summons, registrar administration, oath admin, data processors, and transcribers.

The potentially high number of cases in the 2024 Elections requires adequate preparations in the part of the task force in order to provide support to the constitutional justices. This meeting was expected to result in the finalization and ratification of the PMK concepts.
