JAKARTA (MKRI)—The Constitutional Court (MK) through its Pancasila and Constitution Education Center (Pusdik MK) in Cisarua, Bogor, West Java held a technical assistance program (bimtek) for the management and members of the Association of Indonesian Advocates (Peradi) on Monday, September 5, 2022 at Pusdik, Cisarua, Bogor, West Java.
Deputy Chief Justice Aswanto delivered a keynote speech on the Court’s authority to resolve authority disputes between state institutions (SKLN). He explained that not all state institutions’ authorities come from the Constitution, but they could be delegated.
“This bimtek is not a forum to teach or lecture the participants, but to exchange perspectives. [The Court] believes that without the support of all components of the nation, the Court would have difficulties in performing its duties and functions,” he said to 400 participants of Peradi, which is chaired by Otto Hasibuan.
Authority from Constitution
The deputy chief justice said that today many organizations claim to be state institutions. However, only those whose duties and authorities come from the Constitution that can litigate in the Constitutional Court.
The Court, he revealed, had issued Constitutional Court regulations (PMKs). “Who can bring state institutional disputes to the Constitutional Court? It is those who can represent the institution. We can discuss this further. In the event of such disputes, are the implications only on the state? Are there no implications for the people?” he said.
He believes that when state institutions conflict, it is felt not only by the disputing parties, but also by people in general, who might even bear the brunt of such an issue. The Court’s data shows that there have not been many SKLN petitions lodged to the Court—under 50 cases until today.
Meanwhile, vice chairman of the national executive board (DPN) of Peradi R. Dwiyanto Prihartono thanked the Court for having invited the organizations six times for this program. He said that despite the low number of SKLN cases, information about them would be valuable for the participants.
“With Peradi members participating in this bimtek, it would be a good thing for the nation and state. Hopefully the materials would be disseminated to other Peradi members who cannot participate,” he stressed.
Constitutional Court’s Commitment
Acting head of Pusdik Imam Margono said in his remarks that the Court had the commitment to improve public access to the Court, which guard the citizens’ constitutional rights. This encouraged the Court through Pusdik to organize constitution awareness programs for citizens (PPHKWN) and bimtek, which involve many elements of society. The target of this bimtek, he said, were the management and members of Peradi led by Otto Hasibuan. Peradi, he added, is a friend of the Court.
“[I] am reporting that the Court has collaborated with Peradi six times, since 2019 in Jakarta and Surabaya. In 2020 and 2022, two programs were held each year,” he said.
