MKRI Proposes Constitutional Supremacy Index

JAKARTA (MKRI)—On the second day of the Fifth Congress of the Association of Asian Constitutional Courts and Equivalent Institutions (AACC) on Friday, August 19, 2022, Secretary-General of the Constitutional Court of the Republic of Indonesia (MKRI) M. Guntur Hamzah delivered remarks on behalf of the MKRI during the Board of Members Meeting (BoMM), which was chaired by Chief Justice Chinbat Namjil of the Constitutional Court of Mongolia, the president of the AACC for 2021–2023, from Ulaanbaatar.

He conveyed the MKRI’s proposal of the conception of the constitutional supremacy index (CSI). “After the association’s expansion to that with 21 member-states, it would be an achievement [for the AACC] to pioneer the CSI. This will be a breakthrough for us to make the association an assessment institution not unlike the International Institute for Democracy and Electoral Assistance in Stockholm-Sweden with its democracy index and the International Transparency Institute in Berlin-Germany with its index of perceptions of corruption,” he said virtually from the Constitutional Court building.

He also asserted that as the government of the Islamic Emirate of Afghanistan had dissolved the Independent Commission for Overseeing the Implementation of Constitution (ICOIC), the MKRI recommended that the AACC clarify the matter.

Recalling the BoMM on 2021, hosted by the Constitutional Council of Kazakhstan, where the Constitutional Court of Uzbekistan expressed its interest to become president of the AACC for 2025-2027 after the Constitutional Court of Thailand, Guntur urged all members to prepare themselves for the AACC presidency.

Next, Chief Justice Anwar Usman nominated the Supreme Court of the Philippines, one of the association’s founders, as president after the Constitutional Court of Uzbekistan.

“Among the signatories of the Jakarta Declaration, one member has not hosted the congress. I’d like to propose that [the Supreme Court of] the Philippines host the congress after [the Constitutional Court] of Thailand and [the Constitutional Court of] Uzbekistan,” he proposed.
