Chief Justice: State Committed to Protecting Citizens’ Constitutional Rights

JAKARTA, Public Relations—Advocates affiliated with the Association of Indonesian Advocates (Peradi) participated in a technical assistance program on the Constitutional Court’s procedural law organized by the Constitutional Court’s (MK) Pancasila and Constitution Education Center (Pusdik). These four hundred advocates are management and members of Peradi. Chief Justice Anwar Usman opened the program virtually on Tuesday, August 2, 2022 alongside the acting head of Pusdik Imam Margono and Peradi chairman Otto Hasibuan.

Justice Anwar said provisions of human rights in the Constitution and various laws and regulations in force to date had strongly indicated the state’s commitment to providing protection of constitutional rights for all citizens. The norms contained in the law are a political product formed by the executive and legislative bodies from the democratic process: general elections.

Although these products were formed by two branches of state power by prioritizing the people’s sovereignty, to minimize potential abuses, a power-balancing body was formed: a judicial institution in the form of the Constitutional Court (MK). This institution and its power to examine the law is expected to help form balance in government. Its judicial review authority is expected to be a counterweight to the democratic system that prioritizes people’s sovereignty along norms that reflects a collective agreement in the state.

“Congratulations to the management and members of Peradi on participating in the program in an orderly and solemn manner. Hopefully it will not only be useful for the participants but also for the enforcement of the Constitution and law in our country. [In the name of God, the Most Gracious, the Most Merciful], I declare the technical assistance program on the Constitutional Court’s procedural law for the management and members of the Association of Indonesian Advocates officially open,” said Justice Anwar virtually opening the program.

Introducing Constitutional Court

In his remarks, Peradi chairman Otto Hasibuan expressed appreciation for the Constitutional Court’s professionalism. Although the Court is located in the state capital and many people were not familiar with it, it had made efforts introduce itself to the public, including through the technical assistance program. “This time [the Court] invited advocates within Peradi in one of its efforts to introduce itself to the public,” he said.

Meanwhile, the acting head of Pusdik Imam Margono said in his report that the program will take place for four days on Tuesday–Friday, August 2–5 virtually. Seven subjects on the procedural law of judicial review would be delivered by constitutional justices, substitute registrars, and researchers of the Constitutional Court. The advocates will also learn to draft a judicial review petition.

“The advocates will be assisted by substitute registrars in several online classes. Hopefully all knowledge from this program and practice will benefit the enforcement of the law in Indonesia, especially the fulfillment of the citizens’ constitutional rights,” Imam said.
