JAKARTA, Public Relations—The constitution awareness program (PPHKWN) for workers organizations organized by the Constitutional Court (MK) Pancasila and Constitution Education Center (Pusdik) was officially concluded on Friday, July 29, 2022 by the acting head of Pusdik Imam Margono.

In his remarks, Imam said that as the guardian of the Constitution, the Court has the responsibility to introduce constitutional values and the citizens’ constitutional rights, which are guaranteed in the 1945 Constitution and come from the ideological values based on Pancasila, to the people. “In line with that, the Constitutional Court has also realized its second mission to improve constitutional awareness among citizens and state administrators,” he said virtually.

Imam emphasized that Pusdik coordinated with the workers organizations for the four-day program. The target was selected for the importance of improving workers’ awareness and understanding of their constitutional rights. “[Workers] can also fight for those rights constitutionally through the Constitutional Court,” he said.

Imam said that the program, which took place virtually, would be different if it had taken place onsite. “I believe all the attending workers organizations would want to be here (at Pusdik). We understand that you all hope to be able to do attend in person. However, due to the pandemic our budgets only allowed for online programs, so your wish couldn’t materialize. Hopefully next time it will be realized. Although this program took place virtually, we appreciate your attendance,” he said.

He also expressed his hope that the materials would help the participants understand the constitutional rights guaranteed by the state and spread the materials to other workers.

Participants’ Impression and Suggestion

As the representative of the participants, Evi expressed her impression of and suggestion for the PPHKWN. She was happy and proud of participating in the program. “We apologize for not being able to attend continuously because we had to work and couldn’t take leave four days consecutively. We are happy and proud to have participated in the program because we received a lot of knowledge. We are also impressed by the concept by all of the team,” she said.

Evi wished the program had taken place onsite. “Hopefully in the future the PPHKWN could be organized onsite. We await the in-person meeting so that it will be more interactive. And hopefully this cooperation continues,” she emphasized.

ICT Use in Constitutional Court

On the last day of the program, the participants listen to a presentation on “The Use of Information and Communications Technology in Handling Cases in the Constitutional Court” by the Center for ICT. The legal basis for the use of ICT in the Constitutional Court in carrying out its duty and responsibility to handle constitutional cases according to its jurisdiction is the Constitutional Court Regulation (PMK) No. 18 of 2009 on Electronic Filing and Remote Examination.

“Since 2009, the Court has provided a legal basis for remote hearings. Those who are from the regions do not have to come to the Constitutional Court, so there is no need for great expenses to come to Court hearings. Through video conferencing, the Court holds remote hearings in cooperation with universities in Indonesia. Especially in the pandemic, the Court is consistent in realizing modern and trusted judiciary, just as this citizens constitution awareness program took place on Zoom,” said intermediate computer officer Mazmur Alexander Manik.

He also explained modern judiciary as one that is based on ICT; has advanced mindset and culture; is committed to integrity, cleanliness, and trust. He also said that the internet network is an important infrastructure that supports justice seekers in accessing Constitutional Court’s services.

More importantly, he said, the Center for ICT uses several security systems such as Paloalto, the first firewall to prevent attacks on the networking system; Iron Port to check and filter emails against malware, virus, spam, and so on; Anti DDOS to prevent DDOS attacks that lead to high traffic on the bandwidth; and a mirroring server to back up the server in case it is down.

He also explained that judicial review petitions can be filed electronically to the Constitutional Court. The petition is considered received after it enters the Court’s computer system. 

The 4-day program took place on Tuesday–Friday, July 26–29, involving 246 participants from 8 workers union organizations—KSP BUMN (the Confederation of Trade Unions of State-Owned Enterprises), KSBI (the Confederation of All Indonesian Labor Unions), KSPI 1973 (the Confederation of Indonesian Trade Unions 1973), and others. Judicial review of laws and its procedural law were discussed in the program.
