Labor Party Focuses on Formal Petition Against Lawmaking Law

JAKARTA, Public Relations—The petition revision hearing of the judicial review of Law No. 13 of 2022 on the Second Amendment to Law No. 12 of 2011 on the Formation of Legislation (Lawmaking/P3 Law) by the Labor Party was held by the Constitutional Court (MK) on Wednesday, July 27, 2022 virtually.

The Petitioners’ legal counsel Said Salahudin conveyed the revisions virtually before Constitutional Justices Manahan M. P. Sitompul (panel chair), Arief Hidayat, and Daniel Yusmic P. Foekh.

“Based on advice from Your Honors at the preliminary hearing, we would like to separate the formal and material in the [revised] petition. We will focus on the formal petition. We will file the material petition separately, You Honors,” he said.

In addition, the principal petitioners were added from two to ten people.

Authenticity of Signatures

In response to the revisions, Constitutional Justice Arief Hidayat asked the authenticity of the signatures of the giver of power of attorney, in this case Said Iqbal. He observed the signature on the revised petition had differed from that on the initial petition. He also observed that the signatures of a few other petitioners on the petition differed from those on their KTP (ID cards).

“It is one of the things that we need clarification for,” Justice Arief stressed. He felt the need for authentication of the signatures, given that falsification of signatures had occurred not long ago.

After the justice panel deliberated, they requested that the Petitioners revise the power of attorney. “Therefore, we give no later than one week to the Petitioners to revise the petition. Then there will be notification from the Registrar’s Office regarding when the next hearing will take place,” Justice Manahan said.

The case No. 69/PUU-XX/2022 was filed by the Labor Party, represented by president Said Iqbal and secretary-general Ferri Nurzali. They formally challenged Law No. 13 of 2022 on the Second Amendment to Law No. 12 of 2011 on the Formation of Legislation (Lawmaking/P3 Law).

At the preliminary hearing on Thursday, July 14, Said Iqbal argued that the enactment of the Lawmaking Law could ‘revive’ Law No. 11 of 2020 on Job Creation, which Court had declared formally defective.

“The P3 Law, in our opinion, is the entryway to discussing the Job Creation Law, which the Court declared conditionally unconstitutional and formally defective. Therefore, we have a stake to ensure that the P3 Law [...] be ruled by the honorable Constitutional Justices formally and materially invalid or illegitimate,” he stressed.
