JAKARTA, Public Relations—Chief Justice of the Constitutional Court (MK) Anwar Usman gave a keynote speech while Constitutional Justice Enny Nurbaningsih delivered a presentation at a lecture event entitled “Inculcating Pancasila & the Constitution to Produce Constitutionally Aware Millennials” organized by the Maulana Malik Ibrahim Islamic State University of Malang (UIN Malang) on Saturday, June 4, 2022. Secretary-General M. Guntur Hamzah, UIN Malang Rector Zainuddin, and the academic community of the Sharia Faculty of UIN Malang were also in attendance.
Justice Anwar talked about solidarity among the constitutional justices in carrying out their duties to seek the truth and justice. He cited the Qur’an Surah An-Nisa: 58 on the concept of justice in deciding cases. “Indeed, Allah commands you to return trusts to their rightful owners; and when you judge between people, judge with fairness. What a noble commandment from Allah to you! Surely Allah is All-Hearing, All-Seeing.”
This, he added, is also mandated by Article 24 paragraphs (1) and (2) of the 1945 Constitution: “(1) Judicial power shall constitute an independent power to hold a judicature for law reinforcement and justice. (2) Judicial power shall be made by a Supreme Court and judicial bodies thereunder within a general judicature, religious court, military court, state administration court, and by a Constitutional Court.”
In his speech, Justice Anwar also explained Pancasila as the basic value enshrined in the last paragraph of the Preamble to the 1945 Constitution. Meanwhile, the concept of the rule of law is very clearly stated in the fourth paragraph of the 1945 Constitution: which reads, “... National Freedom of Indonesia is prepared in a Constitution of the State of Indonesia....” The conception of the rule of law is further formulated in Article 1 paragraph (3) of the 1945 Constitution: “The State of Indonesia shall be a constitutional state.”
He also mentioned the role of the youth as a critical and objective group. Data by the BPS (Central Statistics Agency) shows that millennials (born in 1981–1996) were around 69.38 million (25.87%), while Generation Z (born in 1997–2012) reached 74.93 million (27.94%). The youth in Indonesia is equivalent to 53.81% of the total population. Therefore, he emphasized the importance of making this generation aware of the Constitution, resilient, and have achievements and integrity.
Justice Anwar Usman also inaugurated the moot court corner of the Sharia Faculty online. It had been handed over by the Court on October 5, 2021 at Brawijaya University.
Guidelines for the Youth
Constitutional Justice Enny Nurbaningsih in her presentation said that Indonesia faced challenges of the 5.0 era where the people would need to rewire their mindset to realize national goals as stated in the Preamble to the 1945 Constitution.
Millennials or Generation Y, those born in 1980-2000, she said, are known to be familiar with communication, media, and digital technology. They have superior quality of education and an interest in continuing studies to higher levels. They have grown up into open-minded individuals, who uphold freedom, are critical and brave. They work not only to receive a salary, but also to pursue their dreams. They not only pursue job satisfaction, but also self-development.
Justice Enny said that guidelines were needed for the nation and state for this generation of youth. These guidelines come from Pancasila, Bhinneka Tunggal Ika (unity in diversity), and the 1945 Constitution. “So, if these guidelines become the movement of the life of any generation to come, there won’t be any problem in the future because they have been inspired by the guidelines passed down by the nation’s founders,” she said.
Adaptive to the Times
Secretary General of the Constitutional Court M. Guntur Hamzah said at the event that the basic principles mandated in Pancasila and the Constitution should not be eroded because of the extraordinary challenges that lie ahead. Therefore, understanding of the values of Pancasila and the Constitution are required not only textually but also concretely.
“This is an integral part of all of our efforts, including the Constitutional Court, to encourage understanding so that millennials remain adaptive to the times but do not forget their national identity, which is always based on the values of Pancasila and the Constitution,” he said.
