JAKARTA, Public Relations—The Pancasila legal system is unique in that it takes away from both rechtsstaat and the rule of law, as well as other legal systems that existed before, such as customary law and religious law. In it, the law must always have dimensions and is oriented towards justice. The law must not be understood as absolute and rigid, but touched by morality and conscience. That is the essence of the enforcement of the law in Pancasila law-based state. In this context, Pancasila is the ideal of Indonesian law.
This statement was made by the Chief Justice of the Constitutional Court (MK) Anwar Usman in his public lecture on “The Constitutional Court as the Guardian of Pancasila and the Constitution” for Widya Mandira Catholic University (Unwira) in Kupang, East Nusa Tenggara on Thursday morning, June 2, 2022.
Speaking before Vice Rector Samuel Igo Leton, faculty members, and students of the university onsite, Justice Anwar said that Pancasila had become a legal ideal because of its position as the main principle of the state’s fundamental rules (staatsfundamentalnorm). Because of that, it became a guide for the formation of national law. In other words, all legal products that are made and enforced are aimed at realizing the ideas enshrined in Pancasila. On that basis, Pancasila is the source of all sources of law that guide the law. “Pancasila is the starting point as well as the goal of law in Indonesia,” he said.
Justice Anwar asserted that in the concept of law enforcement in Indonesia, efforts to revitalize and internalize Pancasila as a legal ideal among law enforcement officers continued. The transformation of Pancasila values as a paradigm in Indonesian law enforcement is a necessity, with the main goal to ensure that those values remains the basis of every law enforcement activity.
The chief justice also said that Pancasila is the basis of the state’s philosophy and ideology, created by the state founders as a unifying means for the nation to achieve independence. In addition, he added, it is the state’s basis to accommodate its diversity in ethnicity, religion, race, and class while still upholding human dignity in democracy to achieve prosperity and social justice for all its people. Thus, he said, Pancasila is the life goal of the Indonesian people in achieving a prosperous and just society, in a democratic life, full of respect for differences and diversity.
