JAKARTA, Public Relations—The association Perkumpulan Maha Bidik Indonesia, who challenged Law No. 10 of 2016 on the Second Amendment to Law No. 1 of 2015 on the Stipulation of the Government Regulation in Lieu of Law No. 1 of 2014 on the Election of Governors, Regents, and Mayors into Law (Pilkada Law), did not appear for the preliminary hearing for case No. 55/PUU-XX/2022 on Tuesday, May 10, 2022.
“Following today’s schedule, this [was supposed to be] the preliminary hearing for case No. 55/PUU-XX/2022 but this morning the Court’s Registrar’s Office received a letter from the Petitioner that they could not appear for today’s preliminary hearing. Therefore, today’s hearing is postponed until a reschedule by the Registrar’s Office. And thus, this hearing is adjourned,” said Constitutional Justice Saldi Isra as the panel chair.
In the petition, the Petitioner claimed to be an association that researches and study the selection of public officials. They challenge Article 71 paragraph (2) of the Pilkada Law, which reads, “The Governor or Vice Governor, Regent or Vice Regent, and Mayor or Vice Mayor shall be prohibited from replacing officials 6 (six) months before the date of stipulation of the candidate pairs until the end of the term of office unless written approval from the Minister is obtained.”
Highlighting the upcoming 2024 Pilkada, the Petitioner believed that if the phrase “shall be prohibited from replacing officials 6 (six) months” was excluded for regional leaders whose terms of office would end in 2022 and 2023, they could still transfer officials (ASN). The Petitioner alleged that the transfer was motivated by a close relationship with leaders whose terms would be ending and were seeking reelection.
