Court Issues Decree Approving Withdrawal of Petition on Manpower Law

JAKARTA, Public Relations—The Constitutional Court (MK) passed a decree for the judicial review of Law No. 13 of 2003 on Manpower petitioned by freelancer Muhammad Reynaldi Ariananda Arkiang.

“[The Court] declares [to] grant the Petitioner’s request to withdraw the petition,” said plenary chair Chief Justice Anwar Usman alongside the other constitutional justices at a ruling hearing for case No. 17/PUU-XX/2022 on Tuesday, March 29, 2022.

In the decree, the Court also declared the petition No. 17/PUU-XX/2022 on the judicial review of Law No. 13 of 2003 on Manpower (State Gazette of 2003 No. 298, Supplement to the State Gazette No. 6755) against the 1945 Constitution withdrawn and the Petitioner unable to re-file the a quo petition, and ordered the Chief Registrar to record the withdrawal of petition in the electronic constitutional case registration book (e-BRPK) and to return the petition’s copy to the Petitioner.

In its considerations, the Court explained the chronology of the case. The Court’s Registrar’s Office received the petition by Muhammad Reynaldi Ariananda Arkiang dated January 25, 2022. It was recorded in the e-BRPK on February 8 as the petition No. 17/PUU-XX/2022 on the judicial review of Law No. 13 of 2003 on Manpower.

According to Article 34 of the Constitutional Court Law, the Court had performed a preliminary examination on the a quo petition at a panel hearing on March 7. It had provided advice for revision. Then, on March 21 it held petition revision hearing, where the Petitioner did not submit petition revisions and instead withdrew the petition.

According to Article 35 of the Constitutional Court Law, when a petition is withdrawn it cannot be re-filed. Then on March 22, the constitutional justices held a justice deliberation meeting (RPH) that declared the withdrawal of the petition legally warranted and unable to re-file the a quo petition.
