JAKARTA, Public Relations—Secretary-General M. Guntur Hamzah gave a speech at a technical assistance program on state archives/electronic-based state documents organized by Cooperation Program of the National Board of Indonesian Archives Association (PN-AAI) and the Archival Education and Training Foundation (YPPK) on Friday, February 25, 2022. The event, which took place virtually on Zoom had 79 participants.

Starting his speech, Guntur quoted English philosopher Jeremy Bentham, who said, “Publicity is the very soul of justice. It is the keenest spur to exertion and the surest of all guards against improbity.” Without transparency, there will be no justice. Transparency is the means to fight and guard against dishonesty. Guntur said the Constitutional Court is independent from intervention by other institutions. As such, not only the constitutional justices have integrity, but also all of its staff members.

“This is [proof] of the importance of transparency and communication of information through what we know as digital or electronic-based archives, [which] of course makes our business process more transparent. If we understand Jeremy Bentham’s philosophy, there will be no difficulty to carrying out an electronic-based government, or what is known in the Constitutional Court as an electronic-based judicial system,” he said.

He further explained that the Court puts an emphasis on the implementation of information and communications technology (ICT), not only as technology, but also in electronic-based archival system.

“So, the most important thing is that ICT also stands for integrity, [cleanliness], and [trustworthiness]. It is akin to [a blade with] two edges. One is information and communications technology; the other integrity, [cleanliness], and [trustworthiness]. It is because the technology is [run by humans], so it requires integrity [and cleanliness] so that the data is not manipulated and so on,” Guntur said.

Guntur also said that as a judicial institution, the Constitutional Court produces decisions and needs a means to communicate them. “So, our business process uses paper and it can be digitized. Thus, there is no reason for us to not utilize information and communications technology. The Court has many applications for general administration, such as simpel.mkri.id, digital petition, and so on,” he stressed.
