JAKARTA, Public Relations—The Constitutional Court (MK) held another judicial review hearing of Law No. 11 of 2011 on the Attorney General’s Office on Wednesday, February 23, 2022. The second hearing for case No. 9/PUU-XIX/2021, filed by Ricki Martin Sidauruk, was presided over by Constitutional Justices Arief Hidayat (panel chair), Daniel Yusmic P. Foekh, and Manahan M. P. Sitompul.

The Petitioner challenged the reenactment of the provision on the Attorney General’s Office’s authority to file a judicial review (PK) petition. At this hearing, he expressed his wish to withdraw his petition. “At this hearing, I hereby state that I intend to withdraw my petition,” he stressed.

The Petitioner argued that not only did the provision, stipulated in Article 30C letter h of the a quo law, go against his constitutional right to just enforcement of the law, but also it also went against the principle of legal certainty in the law-based state of the Republic of Indonesia. Thus, in the petitum, the Petitioner requested that the Court declare Article 30C letter h of the Attorney General’s Office Law unconstitutional and not legally binding.
