JAKARTA, Public Relations—The Constitutional Court (MK) held a special panel hearing after a revote for the 2020 Yalimo Regency election results dispute for case No. 145/PHP.BUP-XIX/2021, filed by Candidate Pair No. 2 Lakius Peyon-Nahum Mabel on Tuesday, February 15, 2022. Deputy Chief Justice Aswanto (panel chair), Constitutional Justice Suhartoyo, and Constitutional Justice Enny Nurbaningsih heard reports over the revote from the Yalimo Regency KPU (General Elections Commission, Respondent) and the Yalimo Regency Bawaslu (Elections Supervisory Body).

The Petitioners’ legal counsel Heru Widodo reported the revote, which the Respondent had organized on January 26, 2022. The revote had taken place at 327 polling stations (TPS) across 298 hamlets/villages in 5 districts: Abenaho, Apalapsili, Elelim, Welarek, and Benawa. The results showed Candidate Pair No. 1 Nahor Nekwek-John W. Willi receiving 48,504 votes while Candidate Pair No. 2 Lakius Peyon-Nahum Mabel receive 41,548, making up a total of 90,052 votes.

The Respondent also reported that during a plenary recapitulation meeting at the regency level took place, the witness of Candidate Pair No. 2 objected to signing the meeting’s results, citing issues at 4 polling stations in Benawa District. However, after clarification and resolution, everyone accepted the results. The revote and announcement thereof were carried out by the Respondent to fulfill the mandate given by the Constitutional Court in Decision No. 145/PHP.BUP-XIX/2021 (point 6). It was recorded in the KPU Decree No. 301/PL.02.7/9122/2022 dated January 30, 2022 on the Certification of the Revote Recapitulation Post-Constitutional Court Decision on June 29, 2021.

“In addition, these results were announced on the Yalimo Regency KPU’s announcement board. An open announcement was also made on TVRI Papua on Sunday night and on RRI Papua on the next day on January 30, 2022. The candidate pairs’ vote acquisitions were also published on Cendrawasih Pos. As such, the Constitutional Court’s mandate was carried out by the Respondent as it should be. Based on this report, the Respondent requested in the petitum that the Constitutional Court stipulate the report on the revote results by issuing a final verdict to accept the results of the revote dated January 26, 2022 in its entirety,” Heru said.

At the hearing, Yalimo Regency KPU Chairman Yehemia Walianggen also added that when the revote took place, the Respondent had used the DPT (final voters list) from December 9, 2020, which showed 90,948 eligible voters. On the revote day, 90,052 cast their votes, while 896 ballots were declared invalid, and 159 others damaged and subsequently destroyed.

No Findings

Meanwhile, the regency’s Bawaslu Chairman Habakuk Mabel reported that the revote had taken place under Bawaslu’s supervision in 5 districts in the regency. Bawaslu did not encounter any significant reports and findings regarding the revote. He believed the revote and all its processes had taken place successfully and safely.

The Constitutional Court granted the 2020 Yalimo Regency election results dispute petition filed by Candidate Pair No. 2 Lakius Peyon-Nahum Mabel. In the Decision No. 145/PHP.BUP-XIX/2021, the Court also disqualified regent candidate No. 1 Erdi Dabi because he no longer met the requirements as a candidate for the 2020 Yalimo Regency election. The Court also ordered a revote to take place within 120 workdays since it pronounced the ruling and ordered the regency’s KPU to announce its results and report to the Court within 7 workdays after the recapitulation of the voting results was certified.
