JAKARTA, Public Relations—The Constitutional Court (MK) held another judicial review hearing of Law No. 7 of 2017 on General Elections (Election Law) on Tuesday, February 8, 2022 in the plenary courtroom. The case No. 7/PUU-XX/2022 was filed by Ikhwan Masyur Situmeang, an ASN (state civil apparatus). He challenges Article 222 of the Election Law as he believes it had restricted the number of presidential candidates who could participate in the 2024 Election and been against Article 6A paragraph (2) of the 1945 Constitution.

At the second hearing, the Petitioner affirmed his request, “[In the] petitum, [the Petitioner] requests that the Court grant his petition; to declare Article 222 of the Election Law unconstitutional,” Situmeang said before Chief Justice Anwar Usman, Constitutional Justice Arief Hidayat, and Constitutional Justice Daniel Yusmic P. Foekh.

At the preliminary hearing, the Petitioner argued that Article 222 of the Election Law was inconsistent with Article 6A paragraph (2) of the 1945 Constitution because the latter does not mention anything about percentage of the presidential threshold.

In the petition, he also argued that Article 222 of the Election Law in fact restrict the people’s opportunity to assess future leaders from political parties contesting in the elections. He also asserted that the threshold could affect the future of democracy and that allowing it to continue would mean allowing the politics of oligarchs affect the nation. Therefore, in the petitum, the Petitioner requested that the Court annul Article 222 of the Election Law and declare it unconstitutional.
