JAKARTA, Public Relations—The Constitutional Court (MK) approved the request to withdraw the judicial review petition of Article 85 of Law No. 3 of 2011 on Fund Transfer against Article 28D paragraph (1) and Article 28G paragraph (1) of the 1945 Constitution, filed by Indah Harini, at a ruling hearing on Wednesday, December 15, 2021. The Court had, following Article 34 of the Constitutional Court Law, examined the case No. 59/PUU-XIXI/2021 at a panel preliminary hearing on November 17. Following Article 39 of the Constitutional Court Law, the justice panel had also gave recommendations for the Petitioner to revise the petition.
On November 29, the Registrar’s Office received a letter from the Petitioner that requested the withdrawal of the petition. Then, on December 1, a panel petition revision hearing was held, where the Petitioner conveyed the wish to withdraw the petition. Then, the constitutional justices convened at a justice deliberation meeting (RPH) on December 3 and concluded that the request was legally warranted.
“[The Court] grants the Petitioner’s request to withdraw the petition; declares petition No. 59/PUU-XIXI/2021 on the judicial review of Law No. 3 of 2011 on Fund Transfer against the 1945 Constitution withdrawn; declares the Petitioner unable to refile the a quo petition; orders the Chief Registrar of the Constitutional Court to record the withdrawal of petition No. 59/PUU-XIXI/2021 in the electronic constitutional case registration book (e-BRPK) and return the copy of the petition to the Petitioner,” Chief Justice Anwar Usman pronounced.

On December 3, 2019, the Petitioner visited a bank to inquire about the statement of invalid credit account currency that appeared during a fund transfer. On December 10, she revisited the branch to inquire about the same thing. The bank confirmed that it was not a problem and that some money had been transferred to her account.
As there was no claim and report on the transfer, she requested that the money be put into a savings deposit. However, after some time, the Petitioner received information from the bank that the money came from a mistaken transfer, so the bank requested that the Petitioner sign a paper and requested her to return the money. Because she did not receive an official letter, she was not willing to return it. She was then charged for it by the police.
