JAKARTA, Public Relations—The Constitutional Court (MK) held another judicial review hearing of Law No. 10 of 1998 on the Amendment to Law No. 7 of 1992 on Banking on Monday afternoon, November 29, 2021. The Court heard the petition revisions for case No. 58/PUU-XIX/2021.

At the hearing chaired by Constitutional Justice Enny Nurbaningsih, legal counsel Raju Diagunsyah said the Petitioner’s legal standing and the format of the petition had been revised, by including the Constitutional Court Regulation (PMK) No. 2 of 2021 on the requirements for judicial review.

He also conveyed the revision on the elaboration of constitutional impairment as well as the Petitioner’s arguments. “The Banking Law is no longer relevant to the current times and is no longer sufficient [to overcome current] problems and is no longer able to accommodate the complexities that arise in the banking industry,” he explained.

Ex-director of PT BPR Palembang Armansyah argues that Article 49 paragraph (1) letters a and b of the Banking Law is vague and has impaired his constitutional rights. Therefore, in the petitum, he requested that the Court declare Article 49 paragraph (1) letters a and b of the Banking Law unconstitutional and not legally binding. He also requested that the Court declare the imposition of criminal charge to the Petitioner on suspicion of the violation of Article 49 paragraph (2) letter b in Chapter VIII on Criminal Provisions and Administrative Sanctions of Law No. 10 of 1998 on Banking constitutes a legal defect.
