JAKARTA, Public Relations—Constitutional Justices Saldi Isra spoke at a Moot Court Training by the Sharia Faculty of the State Islamic University (UIN) Maulana Malik Ibrahim, Malang on Tuesday, October 26, 2021 virtually. He talked at length about “The Constitutional Court’s Procedural Law,” starting with the Court’s authorities.

Based on Article 24C paragraph (1) of the 1945 Constitution, the Court is granted with four authorities and one obligation: to adjudicate laws against the 1945 Constitution at the first and last level with decisions that are final, to decide on authority disputes between state institutions whose authorities are granted by the 1945 Constitution, to decide on the dissolution of political parties, and to decide on disputes over general election results, as well as the obligation to decide on the House’s opinion on an alleged violation of law committed by the president and/or vice president based on the Constitution.

The procedural law for judicial review, he said, is specific and different from that concerning other authorities of the Court. This is because in a judicial review case, there is no respondent. In such a case, the House of Representatives (DPR), Government, and relevant institutions are not opposing the petitioner, but testify for the constitutional justices regarding the materials of the case. Justice Saldi added that all constitutional justices are assisted by two researchers and one judicial secretary in examining judicial review cases.

“The researchers review the petition. First, they check whether the petition is in accordance with the standard format as per the Constitutional Court Regulation. Second, they observe the Court’s constitutional authorities in settling the a quo case,” he stressed.
