PADANG, Public Relations—Constitutional Justice Arief Hidayat gave a public lecture on “Building Law with Pancasila Character” for the Law Faculty of Andalas University (FH Unand) in Padang, West Sumatera on Friday, October 15, 2021. Unand Deputy Rector III Insannul Kamil, FH Unand lecturer Ilhamdi Taufik, as well as the faculty’s law graduate students attended the lecture both onsite from the campus and online on Zoom.
In his lecture, Justice Arief said that the mobility of mankind has changed lives, so today’s society must be able to use technology. However, technological advances must be guarded with the state ideology so that the nation’s roots are not eliminated. Therefore, the Indonesian society must develop their capacity, make sustainable innovations, and change their mindset.
“This is important so that a global mindset is developed without eliminating locality, so we don’t become losers but champions amid changes,” said the law professor of Diponegoro University.
Justice Arief said the legislatures can be influenced by nonlegal factors, such as social, cultural, political, and economic factors. Law enforcers such as constitutional justices, who apply the law and rule on legal cases, are also influenced by these nonlegal factors. Therefore, both the legislatures and law enforcers are met with options. Similarly, public compliance is also influenced by nonlegal factors.
“Therefore, the conception based on Article 1 paragraphs (2) and (3) of the 1945 Constitution is that Indonesia is not only a constitutional democracy but also a democratic law-based state with the belief in One Supreme God,” he explained.
He also said that law in Indonesia is not secular, but has the character of Pancasila. It is expected that law enforcers do not make the law a commodity, as issues in the legal world is also due to the lack of legal awareness with Pancasila character and belief in One Supreme God among law enforcers when learning the law from its basics. Therefore, he encouraged educators, students, and law enforcers in Indonesia to build the law together with Pancasila character and religiosity, not only that which is based on the common law and civil law systems.
