JAKARTA, Public Relations—Secretary-General M. Guntur Hamzah officially closed the technical assistance program (bimtek) on the Constitutional Court’s (MK) procedural law for judicial review by the Pancasila and Constitution Education Center for the Alumni Association of the Law Faculty of Diponegoro University (IKA FH Undip) on Friday, October 15, 2021. IKA FH Undip Chairman Ahmad Redi and Acting Head of the Pancasila and Constitution Education Center Imam Margono were in attendance.

Before 418 virtual participants, Guntur said that the bimtek was in line with the Court’s core business as a constitutional judicial body. In the four days of the bimtek, the participants had been introduced to the Court’s duties and roles as the guardian of the Constitution by speakers, senior researchers, and deputy registrars from the Court.

“That is why the Court is said to be the guardian of the Constitution and democracy, as it is also authorized to settle presidential, legislative, and regional election results disputes,” he explained to participants, who are advocates, state and regional institution officials, entrepreneurs, CSOs, and student activists within IKA FH Undip.

The Court’s role in relation to general and regional elections, he said, shows the Court’s role as the guardian of democracy as it serves as the last bastion in fighting for justice in the national and local democratic festivities.

Use of ICT

On this day, the participants also listened to a presentation on “The Use of ICT in Case Settlement in the Constitutional Court” by Riska Aprian and Rachman Karim from the Court’s Information and Communication Technology team. Aprian said despite the COVID-19 pandemic, the Court provides speedy and fair trial and pass meaningful decisions at the right moments. The constitutional justices, he said, believe that justice must be upheld no matter what. The Court has utilized ICT long before the pandemic in order to realize its vision to be a modern and reliable judicial body, which it lays out in the Constitutional Court Regulation (PMK) No. 18 of 2019.

“Through this regulation, ICT is utilized as a real effort to provide access to the litigants through the administration of a modern and reliable judicial body,” he said.

Aprian also explained that the litigants can access the electronic case settlement management information system, the Court’s website, the regional election (pilkada) information portal, remote/online court hearings, Click MK, case tracking and online Q&A, hearing schedule, as well as Court decisions and minutes. These features were created to facilitate litigants.

Meanwhile, Rachman explained how to access the electronic petition information system (Simpel), where the petitioner files their petition online, track the developments of their case, access the hearing schedule and court summons, as well as download the minutes or decisions.

The bimtek took place for four days, Tuesday-Friday, October 12-15, 2021. Experts will give presentations—Constitutional Justice Arief Hidayat on “The Constitutional Court and the Characteristic of Its Procedural Law,” former Constitutional Justice (2003-2008, 2015-2020) I Dewa Gede Palguna on “Constitutional Interpretation,” and Constitutional Justice Saldi Isra on “The Procedural Law of Judicial Review of Laws Against the 1945 Constitution.” The participants will also practice drafting a judicial review petition both individually and in groups, with the assistance of researchers and deputy registrars.
