PADANG, Public Relations—Chief Justice Anwar Usman gave a public lecture on “The Citizens’ Constitutional Rights” for the State University of Padang (UNP) on Friday, October 15, 2021. UNP Rector Ganefri and the academic community of UNP attended the lecture onsite.

Justice Anwar in his lecture said that the 1945 Constitution after the amendment gave rise to the concept of power balance where democracy is not only based on people sovereignty through representation in the legislative and executive branches, but where it is balanced with the implementation of the Constitution as the supreme law of the land in what is known as nomocracy. The birth of the Constitutional Court through Article 24 of the 1945 Constitution, with its authorities laid out in Article 24C paragraphs (1) and (2), is also in line with this concept.

He then explained the Court’s authorities: to review laws against the 1945 Constitution, to decide on authority disputes between state institutions, to decide on the dissolution of political parties, and to decide on disputes over general election results. The Court is also obligated to decide on the House’s opinion on an alleged violation of law committed by the president and/or vice president, he said.

“Citizens who feel that their constitutional rights are violated due to the sentence, phrase, or word in a law may request that the Court annul it,” Justice Anwar said.

Justice Anwar also revealed that public education was guaranteed, but the National Education System Law had not facilitated it optimally. So, the Court passed a decision so that the norm petitioned in the case explicitly stated the allotted education funding that met public needs.
