JAKARTA, Public Relations—Deputy Chief Justice of the Constitutional Court (MK) Aswanto gave a keynote speech at the 2021 national work meeting (rakernas) of the Association of Indonesian Advocates-Rumah Bersama Advokat (Peradi RBA) on Friday, October 1, 2021 virtually. Chairman of Peradi RBA Luhut M.P. Pangaribuan was in attendance.

He talked about rechtsstaat and the rule of law, which many experts say have different philosophies. “However, despite their differences, there are similar philosophy between them in that there must be independent, impartial judiciary that can truly provide substantive justice,” he said. He believes it is a consequence of a law-based state. He added that the judiciary should provide justice to justice seekers without preferential treatment.

In the enforcement of the law, advocates must be placed at a proper position. Justice Aswanto said that advocates serve to assist clients who feel that they are denied justice. However, advocates must also participate in improving the system.

In addition, he said that all the institutions that are involved in a case must have a shared understanding of upholding justice. “Advocates, judges, and prosecutors must share the same concept that the goal of any discussion on justice must be realized,” he said.
