JAKARTA, Public Relations—Constitutional Justice Saldi Isra delivered a keynote speech at a review event of the book Kajian Evaluatif Penanganan Pelanggaran Pemilihan Kepala Daerah Serentak Tahun 2020 [“An Evaluative Study of the Resolution of Violations in the 2020 Simultaneous Regional Head Election”] organized by Elections Supervisory Body (Bawaslu) and Andalas University on Tuesday, September 14, 2021. Andalas University rector Yuliandri, Integrated Law Enforcement (Gakkumdu) staff, as well as students and faculty members of Andalas University attended the event virtually and on-site from the university’s hall.
He highlighted the difficulties in implementing laws and regulation on election, which often regulate technical matters. This is because they were passed without any simulation of their implementation. Consequently, when they are implemented, there were many issues. The book, he said, talks about a variety of violations that occurred in the 2020 regional head election (pilkada).
Justice Saldi also leveled criticism at the book, which is based on research on the resolution of pilkada violations. The background of the book, he said, has not shown legal issues in the resolution of pilkada violations. The author/researcher was not able to elaborate the conflict between das sollen and das sein in the resolution of pilkada violations. He hoped the author can talk about it in more detail.
He also highlighted the unclear explanation of what constitutes the enforcement of law in pilkada and the categories of pilkada violations. He wished the research for the book had not only focused on Court decisions on pilkada violations. “It would have been better if the enforcement of the law and the categories of the resolution of pilkada violations are elaborated more,” he said.
That said, Justice Saldi recommended that students would read the book when preparing their papers because its discussion of the resolution of pilkada violations can be used to preface a more in-depth study of pilkada issues.
“This is legal research that followed [the procedure of] a legal study. I also hope that Bawaslu can continue this research in future books and talk about pilkada violations more specifically, such as administrative or criminal violations only, or the types of violations in the regions one by one, such as in Sabu Raijua and Boven Digoel,” he said.
Educating the Public
Ratna Dewi Pettalolo from Bawaslu said that the book was very interesting to read and study because it covers new legal studies on various law enforcement steps in relation to pilkada, starting from administrative to criminal violations. She hoped it would educate the public of the efforts to enforce the law in relation to pilkada and encourage them to participate in realizing democratic elections.
“If the regulations are good, the implementation will be good. This is one of the reasons why the book can be a reference in law enforcement in the resolution of pilkada violations,” she stressed.
