JAKARTA, HUMAS MKRI - Mahkamah Konstitusi (MK) kembali menggelar sidang pengujian Pasal 288 ayat (1), ayat (2), ayat (3) serta Pasal 293 ayat (1), ayat (2), ayat (3) Kitab Undang-Undang Hukum Pidana (KUHP). Sidang Perkara Nomor 21/PUU-XIX/2021 ini digelar pada Senin (13/9/2021) siang secara daring.
Semula agenda sidang hari ini adalah mendengarkan keterangan DPR dan Pemerintah/Presiden. Akan tetapi, DPR berhalangan hadir karena memiliki agenda yang sama sehingga meminta penundaan waktu sidang. Senada dengan hal ini, Pemerintah juga meminta penundaan sidang selama 14 hari.
JAKARTA, Public Relations—The Constitutional Court (MK) held another judicial review hearing of Article 288 paragraphs (1), (2), and (3) and Article 293 paragraphs (1), (2), and (3) of the Criminal Code (KUHP) for case No. 21/PUU-XIX/2021 virtually on Monday afternoon, September 13, 2021. The hearing had been scheduled to hear the statements of the House of Representatives (DPR) and the Government/president. However, the House was absent as they had another appointment. They asked for the hearing to be postponed. The Government also requested a 14-day delay.
“MK menerima surat permintaan dari presiden untuk menunda persidangan ini karena menurut dari surat pemerintah belum siap dan yang diminta oleh kuasa presiden adalah 14 hari penundaannya. Tetapi nanti dilihat jadwal yang sudah disiapkan oleh panitera sesuai dengan kepadatan persidangan. Untuk itu sidang hari ini tidak bisa dilaksanakan sehingga ditunda hingga Senin 4 Oktober 2021 pukul 11.00 WIB dengan agenda mendengarkan keterangan DPR dan Presiden atau Kuasa Pemerintah,” ucap Ketua MK Anwar Usman dalam sidang yang digelar di Ruang Sidang Pleno MK.
“The Court received a request from the president to delay the hearing as the Government was not prepared. The president’s counsel asked for a 14-day delay. However, we will see the scheduled prepared by the Chief Registrar. Therefore, this hearing will be postponed until Monday, October 4, 2021 at 11:00 WIB to hear the statements of the House and the president or the Government’s counsel,” said Chief Justice Anwar Usman at the hearing in the plenary courtroom.

They asserted that the articles are multi-interpretive and unconstitutional. Petitioner I stated that both articles were multi-interpretive and didn’t provide clear legal certainty. He expressed his concern for his female sibling, who is vulnerable to sexual harassment of a minor and to domestic violence due to the lack of legal certainty.
The Petitioners feel that the vague age limit in Article 288 shown in the phrase “not yet marriageable” could lead to a debate. Therefore, in their petitum, the Petitioners requested that the Court declare Articles 288 and 293 of the Criminal Code along the phrases “a minor” and “not yet marriageable not legally binding. They also requested that the Court declare Article 293 paragraph (2) conditionally constitutional.
