JAKARTA, PUBLIC RELATIONS - Justice Arief Hidayat delivered his speech virtually at Constitutional Law Festival 2021 (CLFest 2021) hosted by the Law Faculty of Brawijaya University (UB) in cooperation with the Constitutional Court in Saturday (10/9/2021). 

In the program, he said that Indonesia was different from other democratic countries which were secular countries separating the national and religious life. 

“The Indonesian Constitution consists of the Preamble and Articles. It means that the articles were bound by the Preamble. The articles were based on the Preamble of the Constitution, especially the fourth paragraph,” he said. 

He further explained that the fourth paragraph of the 1945 Constitution emphasized on the goals, visions, and missions of the country. In order to achieve those visions and missions, Indonesia should be based on the 5 (five) clauses contained in Pancasila as the country's ideology. He mentioned that Pancasila encompassed and enlightened the articles of the Constitution. 

“This is something that has not been popularly discussed by people from other perspectives, for example, Indonesia indeed ensures the prosperity of the people however the prosperity of Indonesia was also different. In a secular country, the prosperity was emphasized more on the physical prosperity. Indonesia, the prosperity was physical and emotional (spiritual). Because the visions, missions, and goals of the country should be enlightened by Pancasila,” he said. 

He further stated that in the case of religious constitutional democracy, the first clause of Pancasila did not separate national and religious life or the belief of Indonesian citizens in Almighty God. Therefore, Indonesia was not a secular country. Constitutional democracy in Indonesia was also not a secular one but rather a religious or Godly one. 

“So, we built the law neither rechtsstaat nor rule of law, but the legal system based on Pancasila. Law and Democracy based on Pancasila,” he said.
