JAKARTA, Public Relations—The fourth day of the technical assistance program (bimtek) on Legal Drafting Batch III commenced on Thursday morning, September 9, 2021. A hundred participants joined the program virtually.

The Head of the Sub-directorate for Legislative Design Standardization and Supervision of the Ministry of Law and Human Rights Andriana Krisnawati talked about “Language Variety of Legislation.” She said the linguistic style of legislation must follow the Indonesian grammar in terms of diction, structure, writing technique, and spelling. However, it has its own characteristics based on clarity, straightforwardness, standardization, harmony, and adherence to principles in accordance with legal requirements, both in formulation and writing technique.

“It must be straightforward and precise to avoid ambiguity or confusion, must be simple, uses only essential words, be objective and suppresses subjectivity (not emotional). It must contain standard words, and use expressions or terms consistently, provide the appropriate definitions, natures, or categories,” she explained.

She advised using singular rather than plural forms and to capitalize the initial letter of words, phrases, or terms that have been defined, positions, professions, government institutions/agencies, and types of laws and regulations. She also advised using terms consistently.

“Words in legislation are formed following Indonesian morphology and general guidelines for the formation of terms. Word formation is included in the form and choice of words diction,” she said.

She also explained referencing techniques. Referencing is done through a brief mention of the material being referenced and only of equal or higher laws and regulations.

One the same day, the 100 participants was divided into 16 groups to practice legal drafting.
