JAKARTA, Public Relations—Secretary-General of the Constitutional Court (MK) M. Guntur Hamzah gave a presentation at a national seminar on “Legal Policy for Good Governance and Law Enforcement” by the Law Postgraduate Program of the State University of Semarang (Unnes) virtually on Wednesday, September 8, 2021. Police Chief Commissioner Idodo Simangunsong, Unnes Law Faculty Dean Rodiyah and Vice Dean, as well as lecturers and graduate and postgraduate students of Unnes, UNS (Universitas Sebelas Maret), Soedirman University (Unsoed), Police Academy PTIK, and other higher education institutions.
Guntur Hamzah presented “Legal Policy for Good Judicial Governance.” Legal policies, he said, are related to the law that applies today and will apply in the future. Transparency and accountability are key to good governance in the judiciary, including the Constitutional Court.
He quoted Henk Addink’s view on the three pillars of a modern state: rule of law, democracy, and good governance. Rule of law, he said, can be interpreted as the principle of legality, which in practice relates to the judiciary that oversees the legislative and executive, as well as democracy, which means freedom and equality.
“When the two pillars are implemented, good governance has run in the state. A modern state cannot be separated from good governance,” he said alongside Unnes law lecture Ratih Damayanti who moderated the session.
Guntur added that good governance was reflected in leadership; policy and workplans that fit the judicial mission to uphold law and justice; quality human resources; as well as sufficient infrastructure, facilities, and funding. The judiciary must also provide information to the public.
“Therefore, the Constitutional Court must provide all that justice seekers need transparently. On the Court’s website, all services that the Court provides for the people can be seen at all time. Each case can be tracked and there are all kinds of features to facilitate the people to access the law,” he said.
Independent and Impartial
Good governance in the Constitutional Court requires judicial and administrative control. In simple terms, Guntur said, the judiciary must be independent and impartial. This is reflected in the constitutional justices’ effort in handling cases. They must be able to judge the issue firmly and clearly. They side with the truth and not to any of the parties involved. As such, the judicial and administrative control must be implemented by ensuring the protection of citizens against violations of the law and of their constitutional rights.
The Constitutional Court, Guntur said, implements this judicial duty through five principles of the judiciary: independence, integrity, impartiality, integration, and interconnection. Furthermore, all duties are conducted in a system based on information, communication, and technology (ICT). As a modern judiciary, the Constitutional Court performs work efficiently and effectively by cutting costs and time; minimizing corruption, collusion, and nepotism (KKN); realizing efficient, effective, transparent, and accountable work processes; and improving the quality of its public services.
