JAKARTA, Public Relations—The Chief Justice of the Constitutional Court (MK) Anwar Usman delivered a presentation on the Constitutional Court’s procedural law at the Special Education of Professional Advocate (PKPA) of the Law Faculty of Syiah Kuala University and the Banda Aceh branch executive board (DPC) on Saturday, September 4, 2021.
Justice Anwar began his presentation by saying that the prospective advocates participating in the program had a noble duty that compared to that of judges as they served to uphold law and justice for justice seekers. He also said that advocates even have an edge compared to judges in that they can work in an expansive legal scope to settle a variety of cases. He said that in order to litigate in the Constitutional Court, advocates must understand the process and procedural law in the Court.
Justice Anwar added that the Court’s authority is contained in Article 24C paragraphs (1) and (2) of the 1945 Constitution. Under this article, the Court adjudicates with a final decision that is legally binding, on which no other legal measure can be taken. It also stipulates that the Court has the authority to review laws against the Constitution, to decide on authority disputes between state institutions, to decide on the dissolution of political parties, and to decide on disputes over general election results. It also mandates the Court to decide on the House’s opinion on an alleged violation of law committed by the president and/or vice president.
“Although the Court’s legal scope is limited to those four authorities, the ones who have legal standing in the judicial review are all citizens, on the condition that their constitutional rights are harmed by the enactment of a norm,” he said in the program moderated by Banda Aceh Peradi Chairman Zulfikar Sawang.
Justice Anwar concluded his presentation by expressing his hope that the advocates be able to carry out their duty as enforcers of law and justice based on religious worship. He said that focusing on materials or victory would be superficial. However, with a religious focus, despite losing or finding difficulties, their work would be elevated in the eye of God Almighty.
