JAKARTA, Public Relations—The Constitutional Court (MK) hold another judicial review hearing of Article 33 paragraph (3) and Article 37 of the 1945 Constitution on Monday, July 26, 2021. The second hearing of the case No. 18/PUU-XIX/2021 was presided over by Constitutional Justices Suhartoyo (panel chair), Manahan M. P. Sitompul, and Enny Nurbaningsih.

Petitioner Muhamad Taufiq conveyed the revised petition by himself. At the petition revision hearing, he stated that based on the data by the Ministry of Environment and Forestry, forest fires in Kalimantan and Sumatera in 2015 damaged 2.6 million hectares. This, he said, impacted not only humanity, but flora and fauna therein.

“It can also threaten national stability and impacted the international community. Therefore, the Constitutional Court should extend its authority to review the 1945 Constitution,” he said virtually.

At the preliminary hearing, the Petitioner alleged that Article 33 paragraph (3) of the 1945 Constitution along the phrase “the optimal welfare of the people” and “the land and the water as well as the natural resources therein are controlled by the state” as well as Article 37 along the phrase “Proposals to amend articles of the Constitution can be put on the agenda” violate the first, second, and fifth precepts of Pancasila. He alleged that the articles do not apply to environmental crimes in Indonesia as they do not specify the legal punishments that can be imposed on environmental criminals. Therefore, he requested that the Constitutional Court extend its authority to settle this legal issue.
