JAKARTA, Public Relations—The ruling hearing of the material judicial review of Law No. 15 of 2011 on Election Organizers took place at the Constitutional Court (MK) on Tuesday afternoon, June 29, 2021. The petition No. 19/PUU-XIX/2021 was filed by Siti Warsilah.
“[The Court] grants the Petitioner’s request to withdraw the petition,” said Chief Justice Anwar Usman alongside the other eight constitutional justices at the virtual ruling hearing.
The Court also declared in the decree that the petition had been withdrawn and, thus, cannot be filed again by the Petitioner. It also ordered the Chief Registrar to record the withdrawal in the constitutional case registration book (BRPK) and to return copies of the petition to the Petitioner.

The Court in its legal considerations revealed that on May 11, 2021 the Registrar’s Office had received the petition, dated May 11, from Siti Warsilah, who gave Waway Warsiman and collagues power of attorney. The petition was registered in the e-BRPK on June 3 as case No. 19/PUU-XIX/2021 on the judicial review of the Election Organizer Law.
On June 3, the Court then issued the Decree of the Chief Constitutional Justice No. 19.19/PUU/ TAP.MK/Panel/6/2021 on the Formation of Justice Panel to examine the case as well as the Decree of the Chairman of the Constitutional Justice Panel No. 23.19/PUU/TAP.MK/HS/6/2021 on the Stipulation of the First Hearing for Case No. 19/PUU-XIX/2021.
It then carried out a preliminary hearing with the justice panel on June 15. The Petitioner conveyed at the hearing a different petition than the one registered. The Petitioner explained that the difference also concerned the law and the articles petitioned for review.
The Court then could not provide recommendations due to the marked difference. It advised the Petitioner to reconsider the a quo petition.
The Petitioner was aware of the difference of material and requested to withdraw the petition. She then sent a letter on June 17 on the withdrawal, which was received by the Registrar’s Office on June 22. In a deliberation meeting (RPH) on June 23, the constitutional justices decided that the withdrawal request was legally grounded.
