Implementation of Merit System in Court Deemed “Very Good”

JAKARTA, Public Relations—The Constitutional Court (MK) received 327 points out of 410 on the implementation of the merit system, achieving the “very good” category, said Sri Hadiati Wara Kustriani, a member of the Civil Service Commission’s (KASN) Region I Merit System Supervision Coordinator, at a meeting on the self-assessment for the implementation of the merit system in the Constitutional Court on Tuesday afternoon, June 8, 2021 in the meeting room. She delivered a presentation on “The Final Evaluation Results of the Implementation of the Merit System in the Constitutional Court of the Republic of Indonesia.”

Sri discussed the Court’s implementation of the system, which started with an audience on October 21, 2020; an independent assessment in November 2020 to February 2021; a verification by the KASN in February 2021; clarification and assistance on May 24 and 28, 2021; and determination of implementation level on June 8, 2021 (ongoing).

“There are eight aspects that the KASN assess on the Court’s merit system: planning; procurement; career development; promotion and transfer; performance management; remuneration, rewards, and discipline; protection and services; and information system,” she said before Secretary-General M. Guntur Hamzah and the other officials, who attended the meeting both virtually and in person.

The assessment showed that the Court has fulfilled 94% of planning; 95% of procurement, 58% of career development; 63% of promotion and transfer; 97% of performance management; 88% of remuneration, rewards, and discipline; 100% of protection and services; and 96% of information system.

Out of the eight aspects, the Court received of 37.5 points out of 40 on planning; 38 out of 40 on procurement; 75 out of 130 on career development; 25 out of 40 on promotion and transfer; 77.5 out of 80 on performance management; 35 out of 40 on remuneration, rewards, and discipline; 16 out of 16 on protection and services; and 23 out of 24 on information system. The assessment process for these aspects is still ongoing.

Sri stressed that in government institutions, low scores of career development, promotion and transfer, and performance management were commonplace. However, she highlighted the Court’s career development and relayed the KASN’s recommendation that the Court certifies its SJK (Standard of Position Competency) that it has been drafting, finishes its assessment on all staff that must be updated every three years following statutory regulations, and design a talent pool following the concept of the Regulation of the Ministry of Administrative and Bureaucratic Reform (PermenPANRB) No. 3 of 2020.

Law No. 5 of 2014 on the State Civil Apparatus (ASN) mandated that the merit system be implemented in the management of ASNs. The law defines the merit system as the policies on and management of ASNs based on their qualifications, competencies, and performances that apply fairly and indiscriminately.

The system serves to ensure that positions in the bureaucracy be occupied by professionals—individuals who are competent and able to carry out their duties following the basic values, code of ethics, and code of conduct of ASNs. To achieve this, the KASN, the body authorized to supervise the implementation of the system, maps its implementation in government institutions. The information resulted from the assessment is used to make policies and plan training.

Secretary-General M. Guntur Hamzah expressed his appreciation for the KASN’s evaluation on the Court’s implementation of the merit system. “Of course, there are things that [the Court] must improve with regard to the eight aspects. I believe this is a homework for [the Court]. However, the results overall are good,” he added.
