JAKARTA, Public Relations—Candidate Pair No. 2 Sukiman-Indra Gunawan (Relevant Party) asserted that the revote (PSU) didn’t change the results of the 2020 Rokan Hulu regent election. Through attorney Sri Sugeng Pujiatmoko, they rejected the allegation by Candidate Pair No. 1 of the 2020 Rokan Hulu regent election Hamulian S.P.-M. Sahril Topan (Petitioner of case No. 138/PHP.BUP-XIX/2021) on the second hearing on Friday afternoon, May 21, 2021.

Sri Sugeng said that the recapitulation by the North Tambusai subdistrict election committee (PPK) showed that the revote didn’t significantly impact the candidate pairs’ votes. “What happened was votes for Candidate Pair No. 3 Hafith Syukri-Erizal increased while the Relevant Party’s decreased,” he said.

Continuing the argument, attorney Suryono Pane said that the revote only occurred at those 25 polling stations (TPSs). Even if all voters had cast ballots for the Petitioner, he argued, it wouldn’t have affected the votes since the margin between the two candidate pairs stood at 42,799.

“So, the Respondent only inputted the votes from the revote at the 25 TPSs in addition to the vote results from the Constitutional Court Decision No. 70/PHP.BUP-XIX/2021 that weren’t annulled,” Pane said before Constitutional Justices Enny Nurbaningsih (panel chair), Wahiduddin Adams, and Suhatoyo.

Azhar Hasibuan of the Rokan Hulu Regency General Elections Commission (KPU) testified that after every vote was counted, it was found that Candidate Pair No. 1 received 49,007 votes, Candidate Pair No. 2 received 91,806 votes, and Candidate Pair No. 3 received 90,570 votes. “So, the total number of valid votes is 231,383,” said Azhar in person from the panel courtroom.

Violation Report Results

Meanwhile, the Rokan Hulu Regency Bawaslu (Elections Supervisory Body) through Fajrul Islami revealed two reports of electoral crimes in the election. The first was made by Alirman, who alleged intimidation against the employees of PT Torganda through forceful collection of KTP (resident ID card) and KK (family card). Bawaslu and Gakkumdu (Integrated Law Enforcement) had investigated the report on April 20, 2021 by seeking clarification and proof from witnesses and evidence. “At the meeting, it was decided that the reported incident didn’t meet the criteria of electoral crimes,” he said.

A second report by Hardi Candra alleged that Candidate Pair No. 3 had committed “money politics” or vote buying. In the report of the third meeting by Gakkumdu, it was stated that the investigation regarding the second report was terminated on the grounds of insufficient evidence.

In the case No. 138/PHP.BUP-XIX/2021, the Petitioner requested that the Court annul the regency’s KPU Decree No. 49/PL.02.6-Kpt/1406/KPU-Kab/lV/2021 dated April 24, 2021 concerning the Certification of the Revote Recapitulation Post-Constitutional Court Decision No. 70/PHP.BUP-XIX/2021 in the 2021 Rokan Hulu Regent-Vice Regent Election on April 24, 2021. They alleged structured, systematic, and massive (TSM) violations by Candidate Pair No. 2 Sukiman-Indra Gunawan during the revote at 25 TPSs in North Tambusai Village, North Tambusai Subdistrict.

They also alleged that PT Torganda’s manager had sent a letter to instruct the local community to bring their KTP (resident ID card) and KK (family card) and to ban all employees from leaving the plantation’s premises.
