JAKARTA, PUBLIC RELATIONS - Constitutional Court held the hearing for the 2020 Regional Head Election Results Dispute of North Halmahera Regency on Wednesday (19/05/2021) for case Number 143/PHP.BUP-XIX/2021 filed by Candidate Pair Number 2 Joel B. Wogono and Said Bajak. Petitioner plead the Court to annul the Decree of the General Elections Commision (KPU) of North Halmahera Regency Number 57/Pl.06.2-Kpt/8203/KPU-Kab/IV/2021 concerning the Votes Count Recapitulation Post-Constitutional Court’s Decision Number 57/PHP.BUP-XIX/2021 on the 2020 Regent and Vice Regent Election of North Halmahera dated on April 30th, 2021 at 22.11 WIT (Eastern Indonesia Time).

Previously, the Court ruled in the Decision Number 57/PHP.BUP-XIX/2021 on March 22nd, 2021 in which the Court commanded the KPU of North Halmahera Regency to hold an election redo in 4 (four) polling stations (TPSs), namely: TPS 02 Tetewang Village, Kao Teluk District; TPS 07 Rawajaya Village, Tobelo District; TPS 01 and TPS 02 Supu Village, North Loloda District.

Nofebi Eteua and Junaidi as the Petitioner’s attorney attended the preliminary hearing chaired by Justice Wahiduddin Adams in the plenary courtroom. Eteua mentioned that Petitioner assumed that there was still a violation done by the KPU during the verification and validation of voters data in the TPS located in a company called PT Nusa Halmahera Mineral (NHM).

“It was found that there were several employees who had voting rights and not yet vote on December 9 but their names were not listed as the voters in the election redo in the TPS, neither TPS 01 nor 02,” he said.

Petitioner also found that several employees who had voted on December 9, voted again on April 28th, 2021 during the election redo in either TPS 01 or TPS 02. In regards to this, Petitioner’s witness(es) had also filed an objection in the TPS however KPU still permitted the employees to vote again.

Ending the hearing, Justice Wahiduddin stated that the next hearing for case Number 143/PHP.BUP-XIX/2021 would be held on Friday, May 21st, 2021 at 15.00 WIB with the agenda of hearing the Respondent’s Answer, Explanation of the Relevant Party and Bawaslu, as well as the validation of evidence.
