JAKARTA, Public Relations—The results of the Labuhanbatu regent election revote was challenged in the Constitutional Court (MK). Candidate Pair No. 3 Andi Suhaimi Dalimunthe-Faizal Amri Siregar was the Petitioner for case No. 141/PHP.BUP-XIX/2021.
At the preliminary hearing on Wednesday, May 19, 2021, the Petitioner conveyed their request of the annulment of the Labuhanbatu Regency General Elections Commission (KPU) Decree No. 64/PL.02.6-Kpt/1210/KPU-Kab/IV/2021 on the certification of the revote recapitulation of the 2020 Labuhanbatu regent-vice regent election dated April 27, 2021 at 12:15 WIB.
On March 22, 2021, the Court passed the Decision No. 58/PHP.BUP-XIX/2021 on the 2020 Labuhanbatu regent election filed by Candidate Pair Erik Adtrada Ritonga-Ellya Rosa Siregar (Erik-Ellya). In the decision, it ordered a revote at nine polling stations (TPSs): TPS 005, TPS 007, TPS 009, TPS 010, and TPS 013 of Bakaran Batu Village, South Rantau Subdistrict; TPS 009 and TPS 017 of Siringo-ringo Village, North Rantau Subdistrict; TPS 003 of Pangkatan Village, Pangkatan Subdistrict; and TPS 014 of Negeri Lama Village, Bilah Hilir Subdistrict.
As one of the Petitioner’s attorneys, Yusril Ihza Mahendra, who attended the hearing virtually, explained the alleged violations that had put the Petitioner at a disadvantage. The Respondent (KPU) had allegedly allowed relocated voters and out-of-precinct voters to cast a ballot outside of their supposed precincts. He also alleged that at TPS 014 of Negeri Lama Village, the polling station working committee (KPPS) had allowed voters whose NIK (ID card number) on their e-KTP (electronic resident ID card) and KK (family card) differed from that on the KWK notice C model form to vote at the TPS.
The Petitioner requested that the Court order the Labuhanbatu Regency KPU conduct a revote at 7 TPSs: TPS 5, TPS 9, and TPS 10 of Bakaran Batu Village, South Rantau Subdistrict; TPS 9 and TPS 17 of Siringo-ringo Village, North Rantau Subdistrict; and TPS 14 of Negeri Lama Village, Bilah Hilir Subdistrict.
Before concluding the hearing, Constitutional Justice Enny Nurbaningsih stated that the hearing would resume on Friday, May 21, 2021 at 13:30 WIB to hear the Respondent’s response and the statements of the Relevant Party and Bawaslu (Elections Supervisory Body), and to approve evidence.
