JAKARTA, Public Relations—The Constitutional Court (MK) received a judicial review petition with the highest number of petitioners ever in its history. The petition No. 4/PUU-XIX/2021 on Law No. 11 of 2020 on Job Creation was filed by a record of 662 workers. This was revealed at the preliminary hearing on Tuesday afternoon, April 20, 2021. The Petitioners for case No. 4/PUU-XIX/2021 are the Federation of Chemical, Energy, and Mine Workers Union - All-Indonesian Workers Union Indonesia general chairman R. Abdullah along with 662 other petitioners.
The Petitioners of case No. 4/PUU-XIX/2021 through their attorney filed for formal and material judicial review of the law. They requested that the law be declared in violation of lawmaking provisions according to the 1945 Constitution and, thus, not legally binding. They requested that the Court declare the a quo norms unconstitutional or conditionally unconstitutional. They also requested that several articles in Law No. 13 of 2003 on Manpower be declared valid and legally binding.
Justices’ Advice
Constitutional Justice Arief Hidayat observed that the Petitioners elaborated on the comparison between the Job Creation Law and the Manpower Law more. “That doesn’t show contradiction to the Constitution. Please focus the elaboration on the articles reviewed against the Constitution. You also elaborated more on the articles used as touchstones. You must elaborate on the contradiction,” he advised.
The panel gave the Petitioners 14 workdays to revise the petition. The petition revision hearing will take place on Monday, May 3, 2021.
