JAKARTA, Public Relations—The Constitutional Court (MK) delivered a ruling for the 2020 regent election of Mandailing Natal, North Sumatera Province. The petition was filed by Candidate Pair No. 1 Muhammad Jafar Sukhairi-Atika Azmi Utammi. Through Decision No. 86/PHP.BUP-XIX/2021, the Court granted the petition in part.
“[The Court] grants the Petitioner’s petition in part,” said Chief Justice Anwar Usman alongside the other eight constitutional justices at a virtual ruling hearing from the plenary courtroom on Monday, March 22, 2021.
The Court also ruled to annul the Mandailing Natal General Elections Commission (KPU) Decree No. 2332/PL/02.6-Kpt/1213/KPU-Kab/XII/220 on the certification of the 2020 Mandailing Natal regent election vote counting recapitulation dated December 17, 2020 regarding the candidate pairs’ vote acquisition at TPS 001 of Bandar Panjang Tuo Village, Muara Sipongi Subdistrict as well as at TPS 001 and 002 of Kampung Baru Village, North Panyabungan Subdistrict.
The Court also ordered the KPU to conduct a revote at those polling stations (TPS) no later than 30 working days since the ruling was pronounced as well as appoint polling station working committee (KPPS) chair and members at those polling stations.
Reading out the Court’s legal considerations, Deputy Chief Justice Aswanto stated that based on legal facts, evidence, and testimonies at the hearings, the Petitioner’s argument of vote inflation at those three polling stations were legally grounded.
