JAKARTA, Public Relations - The Court ruled to dismissed the petition for the Lamongan regent submitted by Candidate Pair Number 1 Suhandoyo-Astiti Suwarni.  It is stated on Decision Number 105 / PHP.BUP-XIX / 2021 which was pronounced at the ruling hearing held in the Plenary Court Room of the Constitutional Court on Wednesday (17/2/2021).

Justice Arief Hidayat readout that referring to the votes acquired by the parties, the Petitioner received 296,667 votes, while the relevant party who received the most votes was 336,154. So that the difference between the two votes reached 39,487 votes or equal to 4.9%. This is exceeding the requirement in Article 158 paragraph (2) letter b of Law 10/2016.

Moreover, Hidayat stated that due to the failure to fulfill the provisions, the Petitioner argued that there were violations in the election. However, after observing, reading, and listening to various parties' statements, the Court didn't convince that that norms are being violated.

"The Court does not convince to deviate from the provisions of Article 158 paragraph (2) letter b of Law 10/2016. Thus, the exception of the Respondent and the Relevant Party is legally grounded, ” said Justice Hidayat in a ruling hearing chaired by the Chief Justice Anwar Usman accompanied by other constitutional justices.

At the preliminary hearing, the Petitioner argued that the difference in vote acquisition was caused by violations in the election stages spread across several sub-districts in Lamongan Regency. According to the Petitioner, there are six classifications of violations: violations of the procedures for distributing the number of ballots to the TPS which are contrary to PKPU 18/2020, violations of the corrections by KPPS, violations of the procedure for adding errors at the counting collection stage, violations of opening ballot boxes, violations of the procedures for conducting plenary meetings on the recapitulation of the results of the sub-district level elections, violations of the alleged involvement of ASN, sub-district heads and certain village heads that are structured, systematic and massive.
