The Court Dismissed Bima Regent Election Dispute Due To Over Deadline

JAKARTA, Public Relations of the Constitutional Court— The Constitutional Court (MK) held the ruling hearing of Bima Regent Election Results Dispute on Wednesday (17/02) presided by Chief Justice Anwar Usman accompanied by other Constitutional Justices. The Court declared petition No. 126/PHP.BUP-XIX/2021 unacceptable.  "In the principal pleading, declares that the petition cannot be accepted," said Anwar at the Plenary Courtroom of the Constitutional Court.

In the legal considerations, the Court responded the threshold for filing an election dispute petition. "Bima General Elections Committee (KPU) announced the certification on Wednesday, December 16, 2020 at 16.26 WITA or 15.26 WIB, while the Petitioner filed the online petition to the Registrar's Office on Saturday, December 19, 2020 at 23.07 WIB based on the Petition Filing Certificate (APPP) No. 129 / PAN. MK / AP3 / 12/2020 hence it is past the deadline as specified in the legislation," said Constitutional Justice Manahan MP Sitompul when reading out the legal considerations.

Therefore, the Court did not consider the other exceptions of the Respondent and Relevant Party as well as the legal standing and principal of the Petitioner's petition.

Previously, the petition filed by Candidate Pair No. 2 Syafrudin H.M. Nur and Ady Mahyudi argued that there were systematic, structured and massive (TSM) violations committed by Bima KPU and Candidate Pair No. 3 Indah Dhamayanti Putri and Dahlan M. Noer. These violations have been planned from the beginning, before, during and after voting. Apart from that, the Petitioner also argued that the Respondent did not intentionally convey the invitation to the voters as registered in Final Voters List (DPT). Then, there were underage voters in many Polling Stations (TPS) as well as intimidation in the form of threats from State Civil Apparatus (ASN) if voters did not vote for Candidate Pair No. 3.

Therefore, in their petitum, the Petitioner asked the Constitutional Court to annul the Bima KPU Decree No. 696/HK.03.1-Kpt/5206/KPU-Kab/XII/2020 and the Minutes of December 16, 2020 concerning the Vote Counting Recapitulation of the 2020 Bima Regional Head Elections. (*)
