Nabire Election Dispute: Not a Candidate Pair, Deki-Yunus Lacks Legal Standing

JAKARTA, Public Relations of the Constitutional Court—The Constitutional Court (MK) rendered the 2020 Nabire regent election results dispute petition by Deki Kayame-Yunus Pakopa inadmissible. “[The Court] declares the Petitioner’s petition inadmissible,” said plenary chair Chief Justice Anwar Usman reading out the Decision No. 116/PHP.BUP-XIX/2021 alongside the other eight constitutional justices at a virtual ruling hearing on Wednesday, February 17, 2021 in the plenary courtroom.

In its legal opinion, the Court stated that the Petitioner didn’t have the legal standing to file the a quo petition because they were not an official candidate pair in the 2020 Nabire regent election. Based on the evidence presented during the proceedings, the Court stated that since the Respondent’s and the Relevant Party’s objections regarding the Petitioner’s legal standing were legally grounded, other objections were not considered.

The Petitioner alleged that the 2020 Nabire regent election wasn’t honest and fair as the Respondent had committed violations that hindered the Petitioner from participating in the election. On June 24 to July 21, 2020 the Respondent processed the Petitioner’s documents for verification, but they and the polling committee (PPS) within their supervision had allegedly failed to do a proper verification. This, the Petitioner claimed, violated Article 23 of the General Elections Commission Regulation (PKPU) No. 3 of 2017 in conjunction with the PKPU No. 1 of 2020 and had harmed the Petitioner’s chances to participate in the election.
