JAKARTA, Public Relations of the Constitutional Court—The petition by the Sula regent Candidate Pair No. 1 Hendrata Thes-Umar Umabaihi was rendered inadmissible. The Decision No. 90/PHP.BUP-XIX/2021 on the Sula election results dispute case was read out at a ruling hearing on Wednesday, February 17, 2021 in the plenary courtroom.
The Petitioner earned 17,691 votes while the candidate pair with the most votes (Relevant Party) earned 20,119 votes, so the vote margin between them was 2,428 votes or 4.61%, exceeding the threshold as required by Article 158 paragraph (2) letter a of Law No. 10 of 2016.
The Petitioner had previously alleged that there had been structured, systematic, and massive (TSM) violations. However, they didn’t specify the locations, which hindered the Relevant Party in responding to the allegation.
“Consequently, the Court was not convinced that the allegation had affected the fulfillment of Article 158 paragraph (2) letter a of Law No. 10 of 2016. Therefore, there was insufficient reason for the Court to forward the a quo case to evidentiary hearings,” said Constitutional Justice Manahan M. P. Sitompul reading out the Court’s legal opinion at the hearing, which was held virtually to curb the spread of COVID-19.

At the preliminary hearing, the Petitioner alleged violations in the election, including the number of marked ballots exceeding that of the ballots at the polling stations (TPS), such as in South Mongoli and North Mongoli Subdistricts. They also alleged that voters had been mobilized at several TPS using the DPTb (additional final voters list). They presumed that non-residents had been allowed to votes in the regency.
