JAKARTA, Public Relations of the Constitutional Court—Based on the vote acquisition in the East Bolaang Mongondow regent election, Candidate Pair No. 3 Hi Suhendro Boroma-Rusdi Gumalangit (Petitioner) earned 16,022 votes while the candidate pair with the most votes earned 20,965, resulting in a margin of 4,943 votes or 9.74%. Constitutional Justice Manahan M. P. Sitompul stated this at the pronouncement of Decision No. 111/PHP.BUP-XIX/2021 on the East Bolaang Mongondow regent election dispute petition on Wednesday, February 17, 2021.

The vote margin between the two candidate pairs exceeded the threshold set by Article 158 paragraph (2) letter b of Law No. 10 of 2016. The Petitioner argued that failure to meet the a quo provision was due to structured, systematic, and massive (TSM) violations.

“However, after careful examinations, the Court didn’t find any arguments and initial evidence that convinced [the Court] of such violations,” said Chief Justice Anwar Usman alongside the other eight constitutional justices in the plenary courtroom. He added that the alleged violations wouldn’t have significantly affected the vote acquisition of the candidate pairs, so the Court ruled the petition inadmissible.

The vote margin between the Petitioner and Candidate Pair No. 2 Sam Sachrul Mamonto-Oskar Manoppo (Relevant Party) was 9.74%, but the Petitioner insisted on going forward with the petition. They alleged that there had been violations in the elections, such as letters of recommendation (suket) not validated by the Home Ministry’s Population and Civil Registry (Dukcapil), thus weren’t regarded as legitimate and didn’t comply with the existing provisions. This occurred throughout the regency. Other alleged violations were minors casting ballots in the election, and voters that weren’t listed in the additional final voters list (DPTb) by the polling station working committee (KPPS) on the C model form of KWK additional final voters attendance list, such as at TPS 001 of Moonow Village.
