JAKARTA, Public Relations of the Constitutional Court— The Constitutional Court (MK) dismissed Rembang Regent Election Results Dispute filed by Harno-Bayu. The decision No. 20/PHP.BUP-XIX/2021 read by Chief Justice
In the legal considerations read out by the Constitutional Justice Saldi Isra, the Court stated that the total population in Rembang Regency is 641,647 people. Hence, the difference in the vote acquisition between the Petitioner and the winning candidate is at most 1% of the total valid votes resulting from the final vote count determined by the Rembang General Elections Commission (KPU) in accordance with Article 158 Paragraph (2) Letter C of Law 10/2016.
The Court is of the opinion that the Petitioner has no legal standing because the number of votes differences is 1% x 422,973 votes (total valid votes), namely 4,230 votes. Meanwhile the Petitioners' votes were 208,736 votes. Meanwhile, the votes acquired by the Relevant Party was 214,237 votes. Thus, the difference was 214,237 votes minus 208,736 votes, namely 5,501 (1.3%) or more than 4,230 votes.
Based on these legal considerations, even though the Petitioner is a candidate pair for the 2020 West Sumatra Governor Elections, the Petitioner does not fulfill the requirements for filing the petition as referred in Article 158 Paragraph (1) Letter B of Law 10/2016. "Hence, the Court stated that the Petitioner did not have the legal standing to file the a quo petition," said Saldi.
Previously, the Petitioner argued that they found transferred voters who vote without using the A5 KWK form and there were unsealed ballot boxes from several Polling Stations (TPS) that were not in accordance with the provisions in Article 10 Paragraph (2) Letter D KPU Regulations (PKPU) No. 19 of 2020.
For this reason, the Petitioner asked the Court to annul the Rembang KPU Decree No. 200/PL.02.6-Kpt/KPU-Kab/XII/2020 and asked for re-vote at 44 polling stations in four districts, namely Pamotan District, Sarang District, District Sale, and Sedan District. (*)
